The Legalities of Gambling Online
In most jurisdictions around the world, the law is still a long ways behind the technology and issues applying to online gambling. As a result, the question of whether it is legal to gamble online can rarely be answered definitively. Government attitudes towards online gambling vary significantly. They range from whole hearted support to strong opposition to complete indifference. What is clear though, is that there is very little by way of legislation drafted specifically to deal with online gambling, as it stands, whether positive or negative, and the application of existing laws are proving problematic.
US Position - US State Gambling Laws
Up until fairly recently, regulation of gambling in the United States was left up to the State Legislatures, who determined the legality, or otherwise, of gambling activities within their respective jurisdictions. Some States have legalized many forms of gambling, while others have legislated to make it illegal to participate in any form of gambling other than the State lottery.
Nevada is an obvious example of a State that has embraced gambling as a legal form of commerce, while Utah is noted for its strong anti-gambling stance, and has created laws deeming all forms of gambling within it's jurisdiction illegal.
Herein lies the quandary. US laws dealing with gambling were drafted long before the advent of the Internet and it's present version the World Wide Web.
